TCL to challenge Competition Commission
The Caribbean Court of Justice (CCJ) on Wednesday granted attorneys representing Caribbean Cement Company's parent, (TCL), permission to bring an action against the CARICOM Competition Commission.
The Commission has been conducting an enquiry into the alleged anti-competitive business conduct by TCL in relation to the sale and distribution of its cement products within CARICOM .
TCL sought an order for permission to commence proceedings pursuant to the Revised Treaty of Chaguaramas.
It states that private entities may bring a matter before the CCJ, once special leave has been granted.
After hearing submissions from attorneys for TCL and the CARICOM Competition Commission, the CCJ granted the company leave to commence proceedings.
It ordered that it file its documents to begin the substantive case within 7 days, and that the proceedings be expedited.
