Controversial Muslim cleric Sheikh Abdullah el-Faisal who again lost his challenge against his extradition last week is to appeal the ruling.
This was disclosed by his attorney, Bert Samuels.
The Full Court ruled last week that the Jamaican-born cleric should be extradited to the US to face terrorism related charges, after rejecting his application to be released.
In an interview with RJR News, Mr. Samuels said his client will be appealing the ruling based on comments by one of the judges who had "accepted that (el-Faisal) was entitled to discovery and the original material which he asked for at his hearing... (and) that having not been given that, that he was denied a fair trial."
He said his client has continued to deny the allegations by the American government, and is insistent that he is a cleric and that he has a constitutional right to freedom of religion.
In the Full Court hearing in February, Mr. Samuels argued that the US government failed to make full disclosure of the evidence against his client and therefore his extradition would be unjust and oppressive.
El-Faisal is accused of using the internet to persuade individuals around the world to travel to Syria to take up the cause of the jihad.
US prosecutors say they have audio recordings of him recruiting an undercover cop.
