Student fails to win legal battle against UTECH

University of Technology (UTECH) student Duke Foote, has lost his legal battle to have the University register him for this semester.

On Tuesday, the Supreme Court dismissed the case in which Foote had sued UTECH and its Registrar, Dr Elaine Wallace, for refusing to allow him to register for certain courses.

He had also applied to have the Registrar committed to prison for contempt of  court for failing to register him.

The University had advised Foote he was not eligible to register for the courses as he had not taken the prerequisite courses that were offered in Semester one.

In striking out the claim, the Court found that all of his allegations were based upon alleged breaches of  the Student Handbook.The Court has also ordered him to pay the University’s and Dr Wallace’s legal costs.    

UTECH says while it remains prepared to make special arrangements for students with financial difficulties, there was no basis to make an exception for  Foote.
