Rio Cobre fish kill case to be heard in court November 26

The legal matter involving the National Environment and Planning Agency (NEPA) and mining company Windalco will be heard on November 26 in the St. Catherine Parish Court.
 
The legal action against Windalco stems from the recent fish kill in the Rio Cobre.
 
Peter Knight, Chief Executive Officer of NEPA, said documents were filed in court on Monday and have been served on Windalco.
 
Mr. Knight told RJR News Friday morning that since the summons was served on Windalco, no discussion has taken place between the entities.
 
Windalco is charged under the Wildlife Protection Act. 
 
The NEPA CEO said criminal matters will have to be completed before the possibility of damages. 
 
In addition to the fish kill, there were reports of several residents who became ill after using the water. 
 
In the meantime, Mr. Knight said water from the Rio Cobre is safe for use. 
 
He said the water quality data shows that pH and sodium levels in the river returned to normal on October 21.
